Terms of use

These terms govern use of the website of NUMANTICA PROTECTION, S.L. (B93931103), its contact forms and the private preview environment of the Numantica product (together, the service).

By using the service, you accept these terms together with the legal notice, privacy policy and cookie policy. If you do not accept them, do not use the service.

These terms do not govern provision of the contracted service. Our relationship with clients is governed by the subscription agreement signed by the parties and its annexes, including the data processing agreement. In the event of a conflict, that agreement prevails.

The service is intended for professionals and businesses. By using it, you declare that you are an adult and, if acting on behalf of an organisation, that you have sufficient authority to bind it to these terms. Access may not be available in certain territories or to people subject to international sanctions.

The service is in private preview. During this period, access to all or part of the website, other than the legal documents, requires credentials supplied by Numantica. On receiving them, you agree to:

• Keep them confidential and not share them with third parties.
• Notify us immediately of any unauthorised use or suspected improper access.
• Treat unpublished features, interfaces and materials you access as confidential information.

The preview is provided “as is” for evaluation purposes, without any commitment to availability, performance or continuity. It may be modified, suspended or revoked at any time without notice.

The products, brands, sellers, figures and detections shown in the preview and demonstration materials are fictional or illustrative and are used solely to explain how the product works. They do not describe actual infringements or refer to specific individuals, brands or traders, and must not be interpreted as allegations of unlawful conduct against third parties.

The website’s forms allow you to request a demonstration, contact our sales team or request a callback. Submitting a request does not create an account automatically and does not constitute an offer, acceptance or contract. It is the start of a commercial conversation. Please provide accurate, up-to-date information and do not include third-party personal data or confidential information in free-text fields.

When using the service, you agree not to:

• Use it for unlawful or fraudulent purposes, or to infringe third-party rights.
• Access or attempt to access areas, accounts, data or systems without authorisation.
• Reverse engineer, decompile or disassemble the software, except to the extent expressly permitted by mandatory law.
• Systematically extract or reuse content through bots, scrapers or other automated means.
• Introduce malicious code, or carry out load tests, scans or attacks that compromise security or availability.
• Impersonate another person or entity, or falsely represent yourself as affiliated with Numantica.

If we identify a breach, we may suspend or terminate your access immediately, without prejudice to any appropriate legal action.

The service, its software, design, content, trademarks and documentation belong to NUMANTICA PROTECTION, S.L. or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable licence, without any right to sublicense, to access and use the service in accordance with these terms. No other rights are transferred.

You retain ownership of the content you provide. By submitting it, you authorise us to use it only to the extent necessary to handle your request, provide the service and comply with applicable law. You warrant that you hold the necessary rights to the content you supply.

If you send us product suggestions or feedback, we may freely use them to improve the product, without any obligation to compensate you and without affecting your rights in your own information.

Numantica automatically identifies indicators of potentially unauthorised use of brand assets in public sources. Its results are indicators that require human validation: they may include false positives and false negatives and do not constitute a legal determination of infringement.

The service does not provide legal advice or replace the judgement of your legal advisers. Any decision about reports, content takedowns or action against third parties is the user’s sole responsibility. You must verify the evidence before acting.

We work to keep the service available and operating correctly, but do not guarantee uninterrupted or error-free operation. We may temporarily interrupt it for maintenance, security or reasons beyond our control.

Except for warranties required by mandatory law, the website and preview are provided without express or implied warranties of fitness for a particular purpose, accuracy or completeness of results.

Numantica is liable for damage legally attributable to it. Liability for wilful misconduct or gross negligence, harm to life, physical integrity or health, or liability to consumers under consumer protection legislation is not excluded or limited. Outside those circumstances, and in relation to free use of the website and preview, we are not liable for loss of profit or indirect or consequential damage.

We may amend these terms to reflect legal, technical or service changes. The current version will be published on this page with its last update date. Continued use of the service after publication implies acceptance. These terms remain in effect while you use the service. The provisions on intellectual property, confidentiality, liability and applicable law survive termination of access.

These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Madrid unless another jurisdiction is mandatory. Users who qualify as consumers may bring proceedings before the courts of their place of residence.
